Court fight ahead for health care
The Senate made history by passing legislation that would overhaul the nation’s health insurance system. Though the bill still has to be merged with the one the House passed in November before it can be signed into law by President Obama, this current crop of legislators has come farther than any other in working to make sure Americans have needed healthcare coverage. The legislation, however, may not see the light of day if some state’s attorneys have their way.
Attorneys General from 10 states are working to challenge the constitutionality of the bill’s requirement that every individual buy health insurance. They are also looking to use the fact that some senators, in exchange for their vote, received benefits for their state to form the basis of their legal challenge. For example, Democratic Sen. Ben Nelson of Nebraska was a holdout and didn’t decide to vote for the bill’s passage until he ensured his state would get 100 million in benefits to under the new law. Such benefits would not go to any of the other states.
If passed, the government would require, for the first time, that every American carry some type of health insurance; support would be provided to help those who cannot afford to pay for insurance on their own. Employers would be encourage to provide insurance for employees via tax credits and the insurance industry would not be allowed to deny benefits or charge higher premiums for those with pre-existing conditions such as diabetes.
Passing such monumental legislation – estimated to cost nearly $1 trillion over 10 years – has been no easy tax. Previous administrations have attempted similar fetes but their efforts were bogged down in political red tape. Concessions had to be made along the way and lawmakers from every state worked to ensure the interests of their constituents were at least partially reflected in the bill.
This bill is far from perfect but is a much needed step in the right direction. If this goes to the Supreme Court for decision – and it may if the suits are found to have merit – all of this work could be for naught. The current court is dominated by conservative republicans who share the views of those politicians who refused to support this healthcare bill.
The Attorneys General who wish to stop the passage of the bill should think about the elderly woman who, because of the high cost of medication, cannot afford insulin to manage her diabetes or of the young boy who died from a tooth infection because his parents didn’t have medical care and couldn’t take him to the doctor. These are the types of stories that fuel the desire to begin the real task of reforming America’s healthcare system.

While everyone is considering the legality and constitutionality of this bill perhaps someone should look into the provisions which allows the government to electonically transfer money out of your bank accounts at will without your permission or to examine your financial records without your permission!!

Judge Mathis, just like liar Jesse, just can't get the truth out of his mouth. The only thing he can do is what will gain attention. I could find no record of the incidents he cites. If they actually happened it was out of the sheer stupidity of the people involved. No hospital will deny medical care to people whose life is in danger.

typos, spelling mistakes, grammar,are all things that need to be checked before posting.
A "fete" is a holiday or part, not and accomplishment- didnt you mean "feat".Is "tax" he new version of "task" like "ax" is the current usage of "ask"? Literacy counts!

Yes, the health insurance is needed, but first clean up the present health insurance provisions. Limit liability for doctors, clean up the price of medicine. DO NOT take the money from Medicare Advantage, just get it to operate much more efficiently. That can be done.
Every country in the world that has tried a National Health Plan has had nothing but problems and had to modify it time and again. We do not want nor need a European type of Government control over our lives.

What an amateurish article, this is an editorial not reportage. First, it cites in the most superficial manner the perceived advantages of this bill, without any attempt to even superficially touch on the overwhelming disadvantages. It is as if it were written by a 4th grader from a public school. And . . . the word "fetes" would mean multiple celebrations. I think this author wanted to use the word "feats". It is consistent with the frightening ignorance of this author . . . a judge????

Yes our country does need healthcare reform, but the way in which this bill is undertaking this task is ludicrous. It will cost billions more than they say, increase taxes on the middle class, and further line the wallets of the corrupt politicians from the lobbyists they are protecting at the taxpayers expense. what we could do to decrease healthcare costs... tort reform, go after the insurance companies with provisions on what they can and cannot do, like withhold care for previously existing conditions, and go after pharmaceutical companies that spend billions on lobbying and advertising, but are unwilling to decrease the cost of medication. the bill as it is with all of the earmarks is obscene and offensive to any intelligent person who truly reads into it's content.
And for the two incidents which the judge refers to at the end, if the child's parents had taken the child to the ER the hospital would be required to treat the patient even if they could not pay. the propaganda....yes propaganda, used surrounding this bill is frightening. People need to wake up and realize that our government is unwilling to approach health care reform in the most cost effective way for the taxpayers because it would cut into the politicians kickbacks that they receive from the lobbyist (lawyers, drug companies, and insurance companies).

Prioities now and for the past year should have been - JOBS JOBS JOBS! Of course we need health care improvements but why can't congress make real changes - not just try to buy 31 million votes with legislation that estimated to cost $1 trillion +. Why not get rid of medicare / medicaid fraud now? Why not let health insurance companies compete nation wide? Why not limit liabilities for doctors? Do we really want health care ran by the same Government that is running our homeland security system?

This administration has arrogantly shoved a program on the people of this country which is largely uneeded, unwarranted and almost universally not wanted in it's current form. This is not about our well being but rather about control over our lives.
We need to all remember this during the upcoming elections and let these people know how we feel about this plan in no uncertain terms at the voting booth. It is still not too late to save our country from the coming socialistic wave these people represent.

It is not the job of the federal government to decide upon health care. Nowhere in the constitution of these United States, is congress empowered to use tax money in such a manner, nor is it the right or responsibility of the U.S. Government to stick it's nose in this matter.

I think we need to get away from the Idea of "Insurance" for health care. We all deserve health care! Price is the problem and the solution. Here's an Idea, Cut out the middlemen who drive up the costs. Happy new year I hope.

I thought all the comments were excellent and all touched on the growing concern of the American people that we are headed straight on into Socialism (that's to nice - Fascism and Communism). I'm for upholding the constitution and it seems to be an obstacle for Obama. Pretty soon we won't have a constitution and if we want to leave the country the govt. will not issue passports.

THIS BILL REQUIRES EVERYONE TO BUY OR HAVE BOUGHT FOR HER INSURANCE FROM A PRIVATE FOR PROFIT COMPANY. IF THE PREMIUM IS MORE THAN 8% OF INCOME YOU GET A "COUPON" TO GIVE TO THE PRIVATE INURANCE COMPANY.

Sorry about the lady who can't afford to take care of her medical problem. Obamacare is not the answer. The logic, "let us do evil that good may come" results in more harm than good; that is the problem of this mess of a healthcare bill. There are so many constitutional/legal issues with this folly that the best thing to do is to kill it and start over; get this lady the help she needs without trampling on the Constitutions and the will of the American electorate.

Anecdotal stories are just that, and can be told from both sides, but they don't trump the Constitution of the United States. Whine all you want about the makeup of the Supreme Court, this health care legislation will undoubtedly be stricken down.

The Constitution does not give the federal government the right to force anyone to buy anything.
Buying votes is illegal for citizens as well as for Politicians, especially with other peoples money (taxpayer money).
The Federal Government does not have the right to force private business to supply their staff with health insurance.
The Federal Government is not Constitutionally granted the right to supply a federal government health plan.
The sob stories mentioned in this article are put there only to create sympathy and the stories mentioned could have been handled differently and provided different results.
This is pure manipulating propaganda. You should be ashamed.

What are we going to be forced to do next.
When this starts where will it end. I'll agree we need health care for all but this is not the way to go about it. We should start with RUGULATIONS ON THE HEALTH INDUSTRY,STOP THE FRAUD AND WASTE,PUT THE FOLKS IN JAIL THAT ARE ABUSING THE SYSTEM. Then you would see a lot of improvement with the type of care folks would be able to get.Just think Doctors used to get a Chicken for their services to a Home. The problem today They don't become a Dr. to Help the sic, Seems like its all about the money. How much does a Dr. make today? I may be wrong,But thats my take on it.

I just love reading all of this tea bagging propaganda. Oh the poor old lady...and man, the Constitution is being violated because my main man Obama wants to give every American a reasonable chance to have health care.
Oh, and can you say "affordable" health care? I am positive every commenter here already has health insurance, and doesn't work for a bum who doesn't even offer it. Under Obama's plan I am going to be able to get health care for around $200 a month, after I get my refund coupons. That's frickin awesome! Everybody, even you idiotic conservative tea baggers, deserve to have a shot at getting affordable health insurance.
And oh yeah, for all you "Constituionalists", have you ever even read it? Or did Rush Limbagger and Sean "The Hater" Hannity tell you it was unconstitutional? If affordable health care isn't in the spirit of, "The pursuit of happiness," then I don't know what is! In the meantime, read the constition, and remember you are either already insured and extremely selfish, or you are just another stupid, racist, Obama hater and nuisance to all Americans who work for a living! I say GOOD DAY!
